Further to our previous report, we can now advise that in addition to the GA exposure, there is also a salvage claim. Salvage security is 30% of the cargo CIF value.

We are already representing some cargo on board the vessel in the following ways-

1. Defence of the salvage claim. If the matter goes to arbitration in London, we are able to attend ourselves on behalf of our clients
2. Pursuit of recovery against shipowners of any amounts paid in salvage on no cure no pay terms
3. Defence of GA claim on no cure no pay terms

Reference is made to our initial casualty report below sent last week. This message is an update.

Please note that the Shipowners have now declared General Average. Salvage services were provided on LOF terms. The salvage costs will be paid by the Shipowners who will then claim a share from cargo owners/insurers.

The cargo owners and insurers will be required to provide average bonds and guarantees (or a cash deposit will be required).

We already act on behalf of the insurers of part of the cargo on board this vessel. If you are also insurers of cargo on board then we would be pleased to assist you as well. It is important that the cause of the grounding is investigated so that it can be established whether or not there is a liability to contribute in General Average.

Reports have been received that Antiguan flag vessel GODAFOSS (14664gt built 1995) has run aground off Fredrikstad.

We understand that the containership, which operates between Iceland, Netherlands and Scandinavia, is leaking fuel as a result of the accident.

It is possible that a salvage claim will be made against the owners/insurers of the cargo on board this vessel. It is also possible that general average will be declared.
