Date: 17.09.09     Type: Engine Breakdown and General Average     Voyage: China to Indonesia and Singapore

Reports have been received that Kiribati flag vessel CHENG LU 1 (5157gt built 2005) has suffered an engine failure on her current voyage from Shanghai to Indonesia and Singapore.

As a result of the engine problem the vessel had to be towed into port. The shipowners have now declared general average and the owners and insurers of cargo on board must provide security before the cargo can be delivered.

It is important that the cause of the engine breakdown is established so that it can be decided whether or not cargo insurers should contribute to the shipowners’ costs or whether the general average claim can be rejected.

We can investigate the cause of the engine breakdown and, if appropriate, defend the general average claim for cargo insurers on a “no cure – no pay” basis.
