Legitimate Interest

The GDPR states, ‘the processing of personal data for direct marketing purposes may be regarded as carried out for a legitimate interest’

“Legitimate Interest” in this context means the interests of our company in conducting and managing our business to enable us to provide you with essential information to give you best service.

We may therefore process your personal information for carefully considered and specific purposes which are in our interests and enable us to enhance the services we provide.

“Legitimate Interest” can also apply to processing that is in your interests as well, being of benefit to you or to your commercial advantage.

For example, we have an interest in making sure our news and casualty bulletins are relevant to you, where for example, developments in maritime or insurance law or where timely information on an incident can be critical to effective case management. So we may process your information to send you such notices which we believe are tailored to your interests.

But at the same time, it requires that there is a balance of interests – those of the business and those of the individuals concerned, such as where there is a limited privacy impact on the individuals, where it would be reasonably expected that we use the individuals’ data in that way and where there is an easy route to unsubscribe.

Broadly speaking, legitimate Interests means that we can process your personal information if we have a genuine and legitimate reason seen as being relevant and we are not harming any of your rights and interests.

Therefore, when we process your personal information for our legitimate interests, we make sure to consider and balance any potential impact on you (both positive and negative) and your rights under data protection laws. Our legitimate business interests do not automatically override your interests – we will not use your Personal Data for activities where our interests are overridden by the impact on you (unless required by law).

If you have received one of our bulletins but prefer not be included under the Legitimate Interest category, please Unsubscribe and your data will be removed from our systems, protecting your rights under GDPR.
