*****Fourth Report*****

Following inspections at Port Said, EVER GIVEN is now on its way to discharge ports in Europe.

The Average Adjusters have requested cash deposits of 25% of the cargo value in those case where acceptable general average security is not provided by cargo insurers. This gives an indication of the likely size of the general average claim.

It is important that general average security is provided as soon as possible, to prevent further delays to the cargo, and that the cause of the incident is investigated thoroughly.

*****Third Report*****

After being detained in Suez for nearly three months, EVER GIVEN has today finally sailed for discharge ports in Europe.

This is following settlement of the long-running dispute between the vessel’s owners and the Egyptian authorities.

General Average (GA) was declared shortly after the grounding incident. Cargo insurers have been asked to provide average guarantees before cargoes can be delivered.

It is possible that the GA claim will be quite large. It is therefore of great importance to assess whether all amounts claimed as GA are validly claimed, and also that the true cause of the incident is established.

*****Second Report*****

EVER GIVEN remains anchored in the Great Bitter Lake, Suez.

The containership has now been at anchor for nearly four weeks following the salvage operation last month.

The delay to the vessel, and the thousands of cargoes on board, is being caused by a dispute between the vessel’s owners and the Egyptian authorities concerning money that the Egyptian authorities believe they should be paid for assistance with the salvage of the vessel, and other costs said to have been incurred.

Reports received suggest that the amounts being claimed as salvage are far more than what would usually be expected. If these have to be paid, then the general average claim made against cargo insurers will increase.

We are already representing the insurers of part of the cargo on the vessel. Given the possibly high salvage costs, it is even more important that cargo insurers establish that any amounts claimed in general average are valid general average expenses. We are appointed to assist cargo insurers with this.

We have also retained legal and nautical expert representation in case this is needed to deal with the claims.

*****Initial Report*****

Following the widely reported grounding of the Panamanian flag containership EVER GIVEN (217,612gt, built 2018) last week, the vessel’s operators have now declared General Average (GA).

It is understood that the costs of re-floating the vessel with the assistance or professional salvors Smit and also the Suez Canal Authority will be met by carrier interests in the first instance.

A share will then be claimed from cargo owners and insurers as a GA Claim.

Cargo insurers will be asked to provide average guarantees before the cargo can be delivered.

EVER GIVEN is on a voyage (number 1129 – 011W) from ports in Taiwan, PRC and Malaysia with cargoes for discharge in Rotterdam, Felixstowe and Hamburg, although there will be transhipment cargo on board for other destinations as well.

The vessel sailed from her loading ports on the following dates:

Kaohsiung: 23 February 2021
Qingdao: 27 February 2021
Shanghai: 03 March 2021
Ningbo: 05 March 2021
Taipei: 07 March 2021
Yantian: 09 March 2021
