Date: 19.08.09     Type: Grounding & GA     Voyage: Loading Far East ports but cargo worldwide Voyage 0255N

Update 11th September

Some cargo has been on-carried by the various lines and some is in the process of being on-carried. Repairs to the vessel are continuing in Singapore. Part of the costs incurred in Singapore will be claimed in GA.

We represent cargo with a value in excess of $5m in this case. We believe that a reasonable estimate at this stage is 30% for salvage and 10% for GA.

We are arranging cargo surveys where necessary, and have secured the salvage & GA claims as necessary. We are also considering the recovery aspect and potential defence of GA.

Update 27th August

Salvage security has now been demanded at 30% of CIF values. This is in addition to the GA security.

We represent quite a number of interests in this case, so the assistance will be cost-effective. We are in the process of arranging salvage security for the cargo we represent.

The salvors are still providing salvage services although the vessel has refloated.

Update 25th August

The vessel was refloated at 22.40 hrs on the 22nd August by salvors POSH Semco. The amount of salvage security (which will need to be lodged at Lloyds in the usual manner) is yet to be fixed but our belief is that it will be quite a significant level, in the 25-35% range.

Approximately 500 laden containers were on board the vessel and 100 empty ones.

Update 21st August

Shipowners engaged a salvage tug and there has been ingress of seawater to the forepeak. Some cargo will possibly have to be lightened and the ship will need to undergo repairs.

Shipowners have declared GA and the usual GA securities will need to be provided.

We are already representing cargo interests in this case.

Early reports have been received that Singapore flag vessel PAC AQUARIUS has grounded off Indonesia in the early hours of the 19th August. The vessel is being refloated by salvors.

At this stage it is not yet clear whether the salvage claim will be paid by shipowners in the first instance and potentially recovered in GA, or whether it will be a claim made directly by salvors.
